1. About these Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at futurfund.ca and any related content, features, sweepstakes, contests, and services (together, the “Service”) operated by FuturFund, a registered Canadian non-profit organization (“FuturFund,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use the Service

FuturFund’s content is designed primarily for young women aged 16 to 25. Because our audience includes minors (people under 18 in Ontario), protecting young people is central to how we operate. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly.

If you are under the age of 18 (the age of majority in Ontario), you may use the Service only with the consent and involvement of a parent or legal guardian. Your parent or guardian must review and agree to these Terms on your behalf before you use the Service. We may require verification of parental or guardian consent before allowing minors to enter sweepstakes, submit content, or register for an account. If you are a parent or guardian and believe your child has provided personal information without your consent, please contact us immediately using the details in Section 15.

3. Acceptable use

When using the Service, you agree that you will not:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
Post, submit, or transmit content that is defamatory, harassing, abusive, hateful, discriminatory, obscene, or otherwise objectionable;
Impersonate any person or organization, or misrepresent your affiliation with any person or organization;
Upload or transmit viruses, malware, or any other harmful code;
Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems or networks;
Interfere with or disrupt the operation of the Service;
Collect or harvest personal information of other users; or
Use the Service to send unsolicited communications, promotions, or advertising.

We reserve the right to suspend or terminate access to the Service for anyone who violates these Terms.

4. Educational content is not financial advice

FuturFund provides financial education content designed to help young people build financial knowledge and confidence. This content is for general information and learning only. It is not financial, investment, tax, or legal advice, and it does not take your individual situation into account.

No part of the Service is a recommendation to buy, sell, or hold any financial product. You should seek advice from a qualified professional before making any financial decisions. FuturFund is not a registered financial adviser, dealer, or planner.

5. User-submitted content

The Service may allow you to submit content, such as stories, written responses, photographs, or videos (“User Content”). You are solely responsible for the User Content you submit.

By submitting User Content, you represent and warrant that:

You own or have all necessary rights to the User Content and to grant the licence described below;
The User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party;
Any individuals featured or identifiable in the User Content have consented to its submission and use as described in these Terms; and
The User Content complies with the acceptable use requirements in Section 3.

By submitting User Content, you grant FuturFund a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, adapt, publish, distribute, sublicense, and display the User Content for FuturFund’s charitable, educational, promotional, and community purposes, including across FuturFund’s website, social media channels, newsletters, and other communications. This licence continues for as long as the content is published, but you may ask us to remove your content at any time by contacting us (see Section 15). We will make reasonable efforts to remove content from our active platforms, though copies may persist in archived or cached versions beyond our control. If the contributor is a minor, a parent or legal guardian must provide written consent before submission. We strongly recommend using a separate content release form for all submissions by minors.

FuturFund edits submitted content centrally for brand consistency, and may choose not to use any submitted content. FuturFund is not obligated to publish, credit, or retain any User Content.

6. Intellectual property

Except for User Content, all content on the Service — including text, graphics, logos, the FuturFund name and brand, designs, and educational materials — is owned by FuturFund or its licensors and is protected by Canadian and international intellectual property laws.

You may access and view this content for your own personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from it without our prior written permission.

7. Third-party links and services

The Service may contain links to third-party websites, tools, or resources that are not owned or controlled by FuturFund. We provide these links for convenience only. We are not responsible for the content, policies, or practices of any third-party website or service, and we encourage you to review their terms and privacy policies.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the extent permitted by applicable law, FuturFund does not make warranties of any kind, whether express or implied, about the Service. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any content is accurate, complete, or current. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under Ontario or Canadian consumer protection law.

9. Limitation of liability

To the extent permitted by applicable law, FuturFund and its directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Service. Our total aggregate liability for any claim arising under these Terms will not exceed one hundred Canadian dollars (CAD $100). Nothing in this section excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Ontario or Canadian law.

10. Indemnification

You agree to indemnify and hold harmless FuturFund and its directors, officers, employees, volunteers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your User Content. This indemnification obligation does not apply to minors. Where a parent or legal guardian has consented to these Terms on behalf of a minor, the parent or guardian agrees to indemnify FuturFund to the extent permitted by applicable law. FuturFund may require a separate signed consent and indemnity form from a parent or guardian as a condition of a minor’s participation in certain activities.

11. Sweepstakes and contests

From time to time, FuturFund may operate sweepstakes, contests, or prize giveaways through the Service (“Sweepstakes”). Each Sweepstakes will be governed by these Terms and by specific Official Rules posted for that Sweepstakes. If there is a conflict between these Terms and the Official Rules for a particular Sweepstakes, the Official Rules will govern for that Sweepstakes.

No purchase or payment is necessary to enter or win any Sweepstakes. A purchase will not improve your chances of winning. Sweepstakes are open to legal residents of Canada (and any other eligible jurisdictions stated in the Official Rules) who meet the age requirements set out in Section 2 of these Terms and the applicable Official Rules. Void where prohibited by law.

Eligibility to enter a Sweepstakes is limited to individuals who are at least 13 years of age at the time of entry. Unless the Official Rules for a particular Sweepstakes specifically state otherwise, Sweepstakes are not open to residents of Quebec. Entrants who are under the age of majority in their province or territory (18 in Ontario) must have the consent of a parent or legal guardian to enter. FuturFund may require proof of parental or guardian consent before accepting an entry from a minor. Employees and directors of FuturFund and their immediate family members are not eligible to enter.

To comply with section 206 of the Criminal Code (Canada), selected winners of chance-based Sweepstakes will be required to correctly answer a mathematical skill-testing question without assistance before being declared a winner. The skill-testing question will be administered by email, telephone, or online form at the time of prize notification. The question will be a multi-step mathematical question following the standard order of operations (BEDMAS).

Winners will be notified using the contact information provided at the time of entry. If a winner cannot be reached within seven (7) days of notification, fails to correctly answer the skill-testing question, or fails to comply with these Terms or the Official Rules, the prize may be forfeited and an alternate winner may be selected. As required by section 74.06 of the Competition Act (Canada), the number and approximate value of prizes, the odds of winning, and any regional allocation of prizes will be disclosed in all advertising and promotional materials for each Sweepstakes, as well as in the Official Rules.

By entering a Sweepstakes, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy and the Official Rules. We will only use your entry information for the purposes of administering the Sweepstakes and as otherwise described in the Official Rules. We will not use your entry information for marketing purposes unless you provide separate, express consent. Where we request consent to send you commercial electronic messages under Canada’s Anti-Spam Legislation (CASL), we will do so separately from any other consent request. Each consent request will clearly state the purpose of the messages and how to withdraw consent. Every commercial electronic message we send will identify FuturFund, include our mailing address and contact information, and contain a working unsubscribe mechanism that remains active for at least sixty (60) days after the message is sent.

12. International participants

The Service is operated from Canada and is intended primarily for users in Canada. If you access the Service from outside Canada, you do so on your own initiative and are responsible for complying with the laws of your jurisdiction. By using the Service or entering a Sweepstakes from outside Canada, you consent to the transfer of your personal information to Canada, where it will be processed and stored in accordance with our Privacy Policy and Canadian law. Some Sweepstakes may be limited to Canadian residents only, as specified in the applicable Official Rules. If you are located in the European Economic Area, United Kingdom, or another jurisdiction with data protection laws that differ from Canadian law, please review our Privacy Policy carefully before providing personal information.

13. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we do, we will update the “Last updated” date above and post notice of the change on the Service. For material changes, we will provide at least thirty (30) days’ notice before the changes take effect, where practicable. Where a change affects the rights or interests of minors, we will also take reasonable steps to notify parents or guardians of affected users. Your continued use of the Service after changes take effect means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts located in Ontario, Canada. Nothing in these Terms deprives you of any mandatory consumer protection rights under the laws of your province, territory, or country of residence. If you access the Service from outside Canada, you are responsible for compliance with the laws of your jurisdiction, but these Terms will still be governed by Ontario and Canadian law.

16. General provisions

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FuturFund with respect to your use of the Service. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

FuturFund will not be liable for any failure or delay in performing its obligations under these Terms where the failure or delay is caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, labour disputes, power failures, or internet or telecommunications infrastructure failures.

Before bringing any formal legal proceeding relating to these Terms or the Service, you agree to contact us at hello@futurfund.ca and attempt to resolve the dispute informally for at least thirty (30) days.

FuturFund may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.
